All Landlords must check that each resident is legally allowed to rent the property in question before any deals are finalised. You must ensure that the tenant is over the age of 18 and must provide a valid document for proof. Valid documents can include UK passports, birth certificates, a full or provisional driving license, ETC. All tenants must be checked regardless if they are a British citizen or not. If a tenant is only remaining in the country for a short amount of time you must ensure you complete the age check within the first 28 days of the renting process.

The checks that must be performed are as follows:

• Determine who is going to be renting the property and have them provide any documentation that can confirm that they are allowed to live in the UK
• Use the Government Right To Rent service to check that the tenant is legally allowed to rent the property.
• After the check has been made you should keep copies of the documentation in case it is needed in the future. These documents should be kept through the renting period and for one year after they leave.

Follow-up Checks

If the tenant has a limited amount of time in the country the landlord must perform a follow-up check to ensure they are still legally allowed to live in the country. The Check should be performed either the day before the end of the tenants time within the country or 12 months after the last check has been performed. Failure to carry out these check could result in a fine.
